Terms and condition
1. Relationship and Scope
These Terms outline the rules for using Halal Eats services in Australia. By placing an order or accessing the Halal Eats apps or websites, you agree to these conditions. Different Halal Eats-related companies may provide specific services, and separate terms may also apply depending on the type of service you use.
Meshon Pty Ltd provides the technology platform and app access.
Halal Pty Ltd manages delivery and order-processing (marketplace) services in Australia.
Where delivery or marketplace services are provided by affiliates, additional terms will apply alongside these Terms.
2. Halal Eats Services
Halal Eats offers a digital platform that allows users to:
- Order meals, groceries, and other goods from participating merchants.
- Request delivery of items via Halal Eats or Courier.
- Facilitate payment for these services.
Halal Eats itself does not provide transportation, food, or goods – these are supplied by third-party providers or Halal Eats affiliates.
Licence
Halal Eats grants you a limited, non-transferable right to use its apps and related content for personal, non-commercial purposes.
Restrictions
You must not:
- Copy, alter, or resell the platform.
- Attempt to hack, reverse engineer, or disrupt services.
- Use Halal Eats apps for unlawful purposes.
3. Your Use
Account Setup
You must create and maintain a valid account with accurate personal details and payment information. Only one account per person is allowed unless Halal Eats gives permission otherwise.
Eligibility
You must be at least 18 years old to hold an account. You cannot allow underage users to use Halal Eats services except under permitted conditions (e.g., accompanied travel).
Conduct
You agree to:
- Comply with all laws.
- Avoid misuse, damage, or causing nuisance to drivers, couriers, merchants, or Halal Eats staff.
- Provide correct delivery addresses and ensure safe access for couriers.
4. Payments
Charges
When you place an order or request a service, you agree to pay:
- Service Charges – for deliveries arranged by Halal Pty Ltd or Halal Eats.
- Third Party Charges – for goods or services from independent merchants.
All fees include applicable taxes. Payments are processed through the app using your nominated payment method. If your primary payment method fails, Halal Eats may charge another saved method.
Refunds
Payments are final unless otherwise required under Australian Consumer Law or Halal Eats policies. Refunds may apply for failed or cancelled services where the issue is not your fault.
Cancellations
- Ride cancellations may attract a fee if cancelled after driver acceptance.
- Orders can usually be cancelled within the designated time frame without charge. Later cancellations may result in being charged up to the full value of items and delivery.
- Courier requests cancelled after acceptance may incur a cancellation or return fee.
Additional Fees
You may be liable for cleaning or repair fees if you damage property of a service provider beyond normal wear and tear.
5. Liability and Disclaimers
Halal Eats provides access to its platform on an “as is” basis. While reasonable care is taken, Halal Eats does not guarantee error-free, uninterrupted, or flawless services. Merchants and delivery partners are solely responsible for their goods and services.
Consumer Rights
Nothing in these Terms limits your rights under the Australian Consumer Law. Where applicable, Halal Eats may:
- Replace or repair goods, or refund costs.
- Resupply services or cover the cost of resupply.
Limits
Except where prohibited by law, Halal Eats liability to you is capped at AUD $1,000 for all claims combined. Halal Pty Ltd liability for delivery services is limited to the value of the goods plus delivery costs (subject to additional limits for courier packages).
Halal Eats and its affiliates are not liable for indirect or consequential losses such as lost profits, data, or delays outside their reasonable control.
6. Dispute Resolution
Halal Eats and its affiliates manage complaints and refunds in line with consumer law. You may also escalate matters to relevant consumer protection bodies. Any disputes will be governed by the laws of Queensland, Australia, and handled in its courts unless otherwise agreed.
7. Other Provisions
- Privacy: Personal information is collected and used as outlined in Halal Eats Privacy Notice.
- Notices: Halal Eats may send communications through the app, email, or post. You may notify Halal Eats in writing at its registered address.
- App Stores: If you download Halal Eats apps via Apple or Google, those stores may also have terms that apply.
- Assignment: Halal Eats may transfer these Terms to an affiliate or successor without restriction. You may not assign your rights without Halal Eats consent.
- Severability: If part of these Terms is invalid, the rest remains effective.
- Entire Agreement: These Terms replace any previous agreements covering the same subject.
8. Payment Collection, Settlement & Taxes Clause
Halal Eats is authorised to collect payments from customers on behalf of the Restaurant and the Driver.
All amounts collected by the Halal Eats are deemed to be received by the Restaurant and the Driver at the time of payment by the customer.
Halal Eats will deduct applicable service fees, commissions, and charges before remitting the balance to the Restaurant and the Driver in accordance with the agreed payout schedule.
Halal Eats acts solely as the limited payment collection agent for the Restaurant and the Driver for the purpose of accepting funds from customers and facilitating settlement. The Halal Eats does not hold customer payments in trust.
The Restaurant and the Driver are solely responsible for determining, charging, reporting, and remitting any and all applicable taxes (including GST) arising from the supply of their goods and/or services. Halal Eats makes no representation or warranty regarding tax treatment and will not be liable for any tax obligations of the Restaurant or the Driver.
9. Promotional Codes and Offers
Halal Pty Ltd may issue promotional codes for discounts or credits. These codes:
- Must be used lawfully and as intended.
- Cannot be exchanged for cash.
- May expire or be revoked at any time.
10. Complaints and Support
If you have problems with a delivery, order, or ride, Halal Eats or its affiliates will handle complaints reasonably. Support is available via the help section of the app.
By continuing to use Halal Eats or related services, you confirm that you understand and accept these Terms.
